EU designates ChatGPT as search engines under new digital rules

The European Commission has officially designated ChatGPT a “Very Large Online Search Engine” under the bloc’s Digital Services Act, forcing its parent company, OpenAI, to comply with some of the strictest platform regulations in the world.

The designation, announced on Monday, August 31, 2026, also names Reddit and Roblox as “Very Large Online Platforms” subject to the same sweeping rules. The decision comes after OpenAI reported that ChatGPT had reached 159.1 million monthly active users within the European Union, exceeding the 45 million user threshold that triggers the EU’s highest level of digital oversight.

Under the Digital Services Act, the three services must now submit to annual risk assessments, independent audits, and enhanced algorithmic transparency.

They will be required to explain to users why content is recommended, offer opt-outs from profiling-based feeds, and maintain robust content moderation systems with rights to appeal. Non-compliance carries penalties of up to 6% of global annual turnover.

The EU’s Internal Market Commissioner described the move as a necessary step to ensure that platforms with systemic reach are held accountable for illegal content, threats to fundamental rights, public security, and risks to minors. The Commission now has the power to impose crisis response measures during emergencies and demand rapid changes to platform operations.

While ChatGPT is widely known as an AI chatbot, the EU’s classification as a search engine reflects how users increasingly rely on it to find and synthesise information online. Under the DSA, that functional overlap now subjects OpenAI to the same obligations faced by Google and Bing in Europe.

The company must identify and assess systemic risks linked to how its model generates and surfaces content. That includes evaluating potential harms to civic discourse, electoral processes, and public health. OpenAI will also need to open its systems to external auditing and publish detailed transparency reports on content moderation decisions and algorithmic processes.

Reddit and Roblox face parallel obligations as designated Very Large Online Platforms. Reddit must tighten moderation across its millions of subreddits, while Roblox, a platform with a significant under-18 user base, must strengthen protections for minors and provide clearer parental controls. All three companies have four months to bring their operations into full compliance.

Why this matters to users globally

The EU has built a reputation as the world’s most aggressive tech regulator. Its rules rarely stay confined to European borders. When the EU passed the General Data Protection Regulation in 2018, governments from Lagos to Nairobi studied the framework closely. Nigeria’s National Data Protection Regulation and Kenya’s Data Protection Act both carry clear fingerprints of Brussels’ approach.

That pattern is why Monday’s designation matters to Nigerian tech users, even though nothing about their ChatGPT, Reddit, or Roblox accounts will change today. The EU is effectively writing the first draft of global platform law. If the DSA’s risk assessment and transparency requirements prove enforceable, regulators in other markets, including Africa, will likely borrow from the template rather than reinvent it.

For now, the compliance changes are geofenced. A user in Lagos will not see the same algorithmic transparency dashboard or content moderation appeals process as someone in Berlin. Platforms typically localise regulatory compliance to avoid the cost and complexity of applying one jurisdiction’s rules worldwide.

But the direction of travel is that the EU has decided that AI chatbots with search-like functions are systemic information gatekeepers that need systemic oversight.

Nigerian tech enthusiasts who rely on ChatGPT for research, coding, or content creation should not expect any service disruption. They should, however, expect the conversation around AI regulation to shift.
